Terms of service

General terms for the Fiderium Website Legal Audit for business and professional clients.

Parties and professional organisation

BEDMOND MEDICAL PROJECTS, S.L., tax ID B93645224, registered office at calle Don Cristian, 16, 29007 Málaga, Spain, uses the FIDERIUM brand, manages contracting and administration and invoices the service. It is registered in the Málaga Companies Register, volume 5774, book 4681, folio 213, section 8, sheet MA-147512, entry 1.

The legal audit and validation of the report are personally performed by Juan José Domínguez Baro, lawyer and member 3,448 of the Málaga Bar Association, with independent judgement and under his professional responsibility. BEDMOND pays the lawyer for this work. Contact: jjdbaro@gmail.com.

Professional clients

The service is exclusively for companies, sole traders, professionals and organisations acting for purposes connected with their trade, business, craft or profession. A natural person may contract only where the audited website is predominantly connected with that activity. Any mandatory consumer rule that nevertheless applies will prevail over an incompatible term.

Ordinary scope

The audit is an external legal review of the domain and publicly accessible journeys identified in the proposal. Within the confirmed scope, it covers privacy and forms, cookies and tracking, online sales information and commercial claims.

The proposal will identify included domains, subdomains, languages, countries, purchase journeys and observation date. Other sites, applications, authenticated areas, internal documents and journeys requiring identity, payment or private access are excluded unless expressly accepted. Penetration testing, a full cybersecurity audit, representation before authorities or courts and technical remediation are also excluded.

Request, conflicts and formation

The website form is only a request for contact. Before acceptance, FIDERIUM checks feasibility, availability, conflicts and the professional and tax information needed. A written proposal will specify scope, exclusions, these terms and any particular terms.

The engagement is formed when the client expressly accepts in writing and BEDMOND confirms acceptance. Payment of the first instalment is a condition for work to start but does not replace acceptance. Particular terms prevail in case of conflict.

Electronic contracting and records

Contracting may be completed in Spanish or English by email or an equivalent method. BEDMOND retains the proposal, acceptance, applicable terms and receipts for the relevant periods and provides the client with a storable copy. Acceptance and payment are confirmed electronically. Data errors should be reported before invoicing or corrected afterwards through the appropriate documentary or accounting process.

Price, taxes and payment

The launch price is EUR 395 before taxes, split into two instalments of EUR 197.50 before taxes.

  • First instalment: invoiced once the engagement is formed and payable immediately before analysis begins.
  • Second instalment: invoiced when the report is delivered, unless the Fiderium Guarantee applies.

Spanish VAT applies where appropriate. For B2B services to a client established in another EU Member State with a valid VAT number, the reverse-charge mechanism may apply, subject to the client’s location, status and tax evidence.

Payment is made through a Stripe-hosted invoice page using a card or the wallets displayed by Stripe. BEDMOND does not receive or store complete card details.

Client tax information

Before invoicing, the client must provide its legal name, complete tax address, country and tax or VAT identification number where relevant. The client is responsible for accuracy. EU VAT numbers may be checked through VIES.

Timing and cooperation

The report is delivered within seven calendar days after payment of the first instalment and receipt of all necessary information. Time is suspended while information, clarification or agreed access is outstanding, or where an external technical incident prevents observation.

A material extension of scope or substantial website change requires a new estimate and acceptance. If the client does not respond for 30 calendar days, FIDERIUM may close the engagement after notice and, where possible, deliver work completed to date.

Deliverables and guarantee

Unless particular terms provide otherwise, the client receives an executive report, risk and evidence matrix, P0–P3 priorities, remediation plan and a conclusions meeting of up to 60 minutes.

If the complete audit confirms no medium, high or critical legal risk within the agreed scope, BEDMOND will not invoice the second instalment. Juan José Domínguez Baro professionally certifies that outcome. The guarantee does not mean the website is risk-free, does not cover excluded matters or later changes and does not affect the first instalment for work performed.

Client obligations and limits

  • Provide accurate information and have authority to commission the review.
  • Do not provide unnecessary secrets, special-category data or third-party information.
  • Decide whether and how to implement recommendations.
  • Do not alter extracts in a way that misrepresents the report.

The report reflects the agreed scope, observed state and law considered on the analysis date. It cannot guarantee that every authority, court or third party will share each assessment or that no risk exists outside scope or arises later. Nothing excludes liability for fraud, gross negligence or where exclusion is prohibited by law.

Intellectual property, confidentiality and data

The client may use the report internally and share it with advisers, staff and suppliers involved in remediation. Pre-existing methodology and templates remain the property of BEDMOND or its licensors. Publication, resale or use outside the engagement requires written permission.

The parties will protect non-public information. The lawyer is bound by professional secrecy and conflict duties. Personal data is processed under the privacy policy; where a specific operation creates a controller–processor relationship, the required agreement will be executed first.

Cancellation and incidents

Before written acceptance, either party may end discussions without charge. Once analysis begins, the first instalment pays for reserved and completed work and is not refundable following the client’s voluntary cancellation, except to the extent otherwise required by law or contract.

If FIDERIUM cannot complete the service for a cause attributable to its organisation, it will return the amount not corresponding to useful work delivered. Where prevention results from the client, website changes or failure to cooperate, available work will be delivered and completed work settled.

Delivery and clarifications

Delivery is by email or an agreed link. The client has 15 calendar days to request explanations or report material errors. This does not include a new audit, verification of later changes or implementation.

Extended audit and later services

The initial report may support a second phase for remediation, private areas, contracts or internal processes, other jurisdictions, monitoring or verification of corrections. These services are not included. They require a separate proposal defining scope, deliverables, price, timing and, where relevant, data processing and access.

Applicable law and disputes

The contract is governed by Spanish law. The parties will first seek to resolve issues in good faith through the contact email. Unless a different mandatory rule applies, disputes are submitted to the courts with jurisdiction at BEDMOND’s registered office.

Version

Version dated 3 September 2026. The terms applying to an engagement are those accepted by the client on the contracting date.
